TERMS OF SERVICE

Welcome to Natali Lukas Art. By accessing our website and purchasing our products, you agree to be bound by these Terms of Service.


1. OVERVIEW

Natali Lukas Art ("we," "us," "our") operates ntlukas.com. We offer original paintings and custom commissioned artwork for sale to customers worldwide. These terms apply to all visitors, users, and customers of our store.


2. CUSTOM COMMISSION ORDERS


2.1 Commission Process

  • Custom commissions require a deposit upon order placement

  • Timeline: 1-6 weeks from deposit to completion (small orders 1-2 weeks, large orders 2-6 weeks)

  • We will send a sketch within 1-3 business days for your review

  • You may request amendments (1-3 business days for revisions)

  • After sketch approval, we create the artwork on the approved surface and size

  • Upon completion, we send photos of the finished artwork for your approval

  • Artwork must dry before shipping (drawing: 2-3 days; watercolor: 3 days; oil: 1-6 weeks depending on size)

     

2.2 Approvals & Revisions

  • You must respond to approval requests within 7 days, or the stage will be considered approved

  • 1-2 rounds of minor revisions in sketch and 1-2 rounds in painting are included in the commission price

  • Minor revisions include small color adjustments and positioning changes

  • Major revisions include changing size, surface, subject, composition, or style

  • Major changes or additional revisions beyond 3 rounds may incur additional fees

     

2.3 Custom Order Requirements

  • For commissions from photos, you must provide high-quality images with sufficient contrast where all important details are visible

  • You are responsible for ensuring you have rights to any reference photos provided


3. INTELLECTUAL PROPERTY & COPYRIGHT

All artworks are exclusive original paintings created by Natali Lukas and are protected by copyright.


3.1 Personal Use License

  • Artworks purchased are for personal use or as gifts only

  • You may NOT reproduce, copy, print, scan for printing, or create derivatives of the artwork

  • Copyright © Natali Lukas - All rights reserved

     

3.2 Commercial Use

  • Commercial licenses are available only with prior written consent and additional payment

  • Contact us before using any artwork for commercial purposes

     

4. PRICING & PAYMENT

  • All prices are listed in USD

  • Payment is required at time of order (or deposit for custom commissions)

  • We accept payment through our approved payment providers

  • Prices are subject to change without notice, but changes will not affect orders already placed

     

5. SHIPPING & DELIVERY


5.1 Shipping Methods

  • All items are carefully packed in paper and hard cardboard

  • Standard international shipping with tracking number provided

  • Express shipping available for additional cost (UPS Express to US: 6-10 business days)

  • You will receive photos of packaging and tracking updates


5.2 Shipping Costs & Taxes

  • Shipping costs calculated at checkout based on destination and item size/weight

  • For US shipments, we pay 10% tax in Ukraine

  • Customers are responsible for any customs duties, import taxes, or fees imposed by their country

  • Gift wrapping available for additional cost


5.3 Risk of Loss

  • Risk of loss and title for items pass to you upon delivery to the carrier

  • We track all shipments and notify you when packages arrive in your country


6. RETURNS & CANCELLATIONS


6.1 Custom Commissions

  • Custom commissioned artwork is non-refundable once the sketch has been approved

  • If you fail to respond to approval requests within 7 days and the work proceeds, no refund will be issued

  • Deposits are non-refundable once work has commenced


6.2 Original Artwork (Non-Custom)

  • Contact us within 7 days of receipt if there are issues with your order

  • Items must be returned in original condition

  • Return shipping costs are the responsibility of the customer unless the item is defective

     

7. ACCURACY OF INFORMATION

We strive to ensure all product descriptions, colors, and images are accurate. However, we cannot guarantee that your device's display will accurately show the colors of the artwork. Slight variations may occur between photos and the physical artwork.


8. PROHIBITED USES

You may not use our site or products to:

  • Violate any laws or regulations

  • Infringe on intellectual property rights

  • Transmit harmful or malicious code

  • Engage in unauthorized framing or linking

  • Resell or commercially exploit our artwork without permission


9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Natali Lukas Art shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or services.


10. INDEMNIFICATION

You agree to indemnify and hold Natali Lukas Art harmless from any claims, damages, or expenses arising from your breach of these Terms or your use of our products.


11. GOVERNING LAW

These Terms of Service are governed by the laws of Ukraine. Any disputes shall be resolved in the courts of Ukraine.

 

12. CHANGES TO TERMS

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our store after changes constitutes acceptance of the new terms.
